General Terms and Conditions for the Participation in Events of SILPION Events GmbH
1 Scope of Application
These General Terms and Conditions shall govern the contractual relationship between you as a participant at events (seminars, courses, conferences, etc.) and SILPION Events GmbH, Brandshofer Deich 48, 20539 Hamburg, registered in the Commercial Register of the Hamburg Local Court under number HRB B 135983 (hereinafter referred to as “SILPION Events”). Any deviating general terms and conditions of the participant are explicitly rejected. These shall have no validity.
2 Registration/Confirmation of Registration
You can register for the events by SILPION Events via the event website, via the internet, by post, fax, email or phone. Your registration constitutes an offer to conclude an event agreement, to which you are bound for 10 days. Your offer will be accepted through written confirmation by SILPION Events or a confirmation in text form. If we declare our acceptance after the end of your commitment period, our confirmation constitutes an offer to conclude a corresponding agreement, which you can accept by paying the relevant fee. In this case, we waive receipt of a corresponding declaration pursuant to Section 151 of the German Civil Code (BGB).
Unless specified otherwise in the event announcement, fees normally include access to the event, the event documents in electronic form and beverages during breaks. SILPION Events reserves the right to replace announced speakers by others and to make necessary changes to the event programme while maintaining the overall character of the event.
If an event cannot take place on account of force majeure, because a speaker, or several speakers, is/are unable to attend, due to disruptions at the event venue or because the number of participants is too low, the participants will be informed immediately. If the number of participants is too low, notice of cancellation will be given no later than 10 days before the event. The participation fee is reimbursed in these cases. Any claims for reimbursement of travel and accommodation costs or loss of working time are excluded, unless such costs are incurred due to gross negligence or wrongful intent on our part. In the event of any disruptions, SILPION Events shall make all reasonable efforts to remove or minimise such a disruption.
The fees specified for the relevant event are per person and event date, plus the applicable value added tax. If special discounts are granted for certain events (e.g. for students, certain professions, etc.), you are required to submit relevant documentation and/or certificates as proof that you meet the relevant requirements. Regarding early booking discounts (early bird rates), the actual receipt of your registration shall be decisive.
4 Due Date and Payment of Fees, Default, Offsetting
The fee payable for the relevant event becomes due upon receipt of the confirmation of participation and the invoice and is payable within 14 days from receipt of the invoice. Section 286 para. 3 BGB shall not be affected. In the event of default of payment, we are entitled to charge consumers interest of five percentage points and merchants nine percentage points above the applicable base rate of the ECB (Section 247 para. 1, Section 288 para. 1 or para. 2 BGB) per year. SILPION Events shall be entitled to demand compensation for higher losses incurred against submission of evidence. You are also entitled to prove that SILPION Events has not incurred any losses or that they were significantly lower than demanded.
Unless a certain fee is specified in the announcement of the event, you are generally entitled to pay the fee at your discretion by direct debit, against invoice or by credit card. SILPION Events reserves the right to exclude certain methods of payment in the individual case. Payment by sending cash or cheques is not possible; SILPION Events assumes no liability in the event of loss.
Offsetting against counterclaims is only possible if these are acknowledged by SILPION Events in writing or finally adjudicated. You may exercise the right of retention only if your right is based on the same contractual relationship.
The cancellation of your registration must be made in writing. Cancellation at no charge is only possible up to 30 days before the start of the event. In the case of cancellation between 29 and 14 days before the event, you are required to pay 50 %, between 13 and 7 days before the event 75 % of the relevant fee.
In the case of cancellation less than 6 days before the start of the event or non-attendance, the whole fee agreed upon is payable. You are entitled to designate a substitute participant. You are also principally entitled to prove that SILPION Events has not incurred any losses due to the cancellation of the event or that they are significantly lower than the cancellation fee charged by SILPION Events.
All event documents, images, hand-outs, etc. (whether in physical or electronic form) that you receive at events of SILPION Events are protected by copyright. The author mentioned in the relevant document is entitled to copyright. You are only granted a simple, non-exclusive, non-transferable right of use for private purposes. You or any third parties are not entitled to make content-related or editorial changes in the event documents or to use changed versions, to copy them for third parties, to make them available to the general public or to forward them, to publish them on the internet or any other networks for or without a fee, to imitate, sell or use them for commercial purposes, including in the form of extracts. You or third parties are not entitled to remove any copyright notices, marks or trademarks.
7 Consent to Photo and Video Shootings
Photo and video recordings are made at all events organised by SILPION Events, which are subsequently published on the websites of SILPION IT-Solutions GmbH and its associated and/or subsidiary companies as well as on social media channels and platforms such as Facebook, Instagram, YouTube, Twitter, Flickr, etc. to document the event. In addition, a promotional video showcasing scenes from the event will be produced.
This video will be used by SILPION IT-Solutions GmbH online and offline in any media and, in particular, for corporate promotional purposes. In this context, group pictures and individual portraits of the visitors of the event will be made.
When entering the area of the event, visitors agree to being photographed or filmed during their visit of the event and that such photos or videos are published as mentioned above. Visitors are prohibited from making their own audio or video recordings.
The events are diligently prepared and carried out by qualified speakers. Nevertheless, we assume no responsibility for the topicality, correctness and completeness regarding the event documents provided to you and for the execution of the event.
The contracting parties are mutually liable without any restrictions in the event of injury to life, limb or health, breach of quality guarantees, malicious concealment regarding defects, breach of material contractual duties (so-called cardinal duties) and for intentionally caused damage, regardless of the cause. Liability pursuant to the provisions of the Product Liability Act shall not be affected.
Otherwise, the contracting parties shall be liable up to the amount of the agreed total fee for the relevant event.
The aforementioned limitations of liability also apply to the corporate bodies, executives, employees and/or vicarious agents of the contracting parties.
Special limitation of liability for wardrobe
If we offer the opportunity, with or without a fee, of storing any objects such as coats, jackets, suitcases or bags on your behalf (“cloakroom”), the following additional provisions shall apply:
- You may not hand over to the cloakroom any objects of value (e.g. laptops, smartphones, jewellery), data carriers with confidential and/or business information, means of payment, payment cards or travel tickets.
- We shall be liable without any restrictions for property damage and financial losses due to damage to or loss of objects only in the event of intentional or grossly negligent acts of any of our bodies and/or vicarious agents, in the event of injury to life, limb or health, breach of quality guarantees, malicious concealment regarding defects, as well as for intentionally caused damage, regardless of the cause; otherwise, liability is excluded.
9 Age restriction
Normally, access to events of SILPION Events is possible for individuals from the age of 18 and up. Young people from the age of 16 and up are granted access until 12 p.m., provided that they are accompanied by a custodial person or a person with parental power.
Persons with parental power must bring a written power of attorney with them and shall, on request, present a copy of the identification card of the custodial person.
10 Right of Cancellation for Consumers
Participants whose registration is not attributable to their commercial or independent professional activity (consumers within the sense of Section 13 BGB) have the right to cancel their registration in writing without stating any reasons within 14 days from receipt of the confirmation of registration. No cancellation fees will be charged. Timely dispatch of the cancellation notice to the following address is sufficient for observance of the deadline: Silpion Events GmbH, Brandshofer Deich 48, 20539 Hamburg, fax: 040/39 99 76 40. This right of cancellation expires prematurely if the booked event has taken place and the participant has taken part. The following cancellation policy shall apply:

You have the right to cancel this agreement within fourteen days without stating any reasons.
The period of cancellation is fourteen days from the date of conclusion of the agreement.
In order to exercise your right of cancellation, you must notify SILPION Events GmbH, represented by the Managing Director, Patrick Postel, Brandshofer Deich 48, D-20539 Hamburg, fax +49 40 39 99 76-40, tel.: +49 40 39 99 76 0, firstname.lastname@example.org, via a clear declaration on your decision to cancel this agreement (e.g. by way of a letter sent by post, fax or email). You can use the attached sample cancellation form, which is not obligatory.
To comply with the cancellation period, it is sufficient to send the cancellation notice prior to the expiry of the cancellation period.

Consequences of cancellation
Upon your cancellation this agreement, SILPION Events is required reimburse all payments received from you, including delivery costs (except for additional costs resulting from you having chosen a type of delivery other than the most economical standard delivery offered by us), without undue delay and no later than fourteen days from the date of receipt of your notice of cancellation by SILPION Events. For this repayment, SILPION Events will use the same means of payment which you used for the original transaction, unless otherwise explicitly agreed with you; in no event will we charge any fees for repayment.
Should you have requested that the services commence during the cancellation period, you shall be required to pay SILPION Events a reasonable amount that corresponds to the ratio of services already provided by the date on which you notify SILPION Events of your exercising the right of cancellation of this agreement to the total scope of services stipulated in the agreement.
